Online Dispute Resolution: The Perspective of Service Providers, by Dr. Marco Giacalone and Sajedeh Salehi

[New book] Dr. Marco Giacalone and PhD candidate Sajedeh Salehi have contributed to a chapter in the e-book on ‘Algorithmic Conflict Resolution: Fair and Equitable Algorithms in Private Law’, Where Dr. Giacalone has also been an editor. The e-book reflects on the use of online dispute resolution (ODR) and algorithms for resolving conflicts in civil and commercial matters.

The title of the chapter is ‘Online Dispute Resolution: The Perspective of Service Providers’ and examines the application of ODR with the specific focus on resolving civil disputes. The contribution begins with providing an introduction to the concept of ODR clarifying the major distinguishing characteristics that differentiate it from alternative dispute resolution (ADR). Additionally, it will provide a thorough overview of two types of ODR namely, E-Negotiation and E-Mediation followed by arguing the applicability of these two principles in the ODR field in the global context. Eventually, the authors analyse the establishment and implementation of the EU ODR platform which was launched by the EU Commission to improve the efficiency of conflict resolution between traders and consumers through providing them with access to quality dispute resolution mechanisms procured by dispute resolution bodies.
