On 17 May 2024, 12:30h - 13:30h CET, LSTS visiting scholar Maria Skwarcan (doctoral researcher at the Cardinal Stefan Wyszynski University in Warsaw) will present her PhD research, entitled 'Personal data monetisation in the data economy in the light of the protection of fundamental rights in the European Union', followed by discussion.
Abstract: The research project addresses the question of the lawfulness of personal data monetisation and commodification in light of the prevailing European Union’s (EU) system of human rights protection. While the EU law does not specify whether personal data is a transferable good, the issue is a subject of lively debate from the perspective of the inalienability of fundamental rights.
The project's primary objective is to propose a novel approach to personal data monetisation, reconciling different interests and rights expected to fill the research gap identified through a literature review. The main research objective is linked with particular narrower objectives. One of them involves carrying out a comprehensive legal analysis of the prospective collision between various fundamental rights protected by the EU law in the context of personal data monetisation practice, with a focus on the analysis of the intersection between the freedom to conduct a business and the right to the protection of personal data.
