We are delighted to welcome Professor Marie-Laure Basilien-Gainche, Professor of Law at the University Jean Moulin Lyon 3, Senior Member of the Institut Universitaire de France, and member of both the Institut Convergences Migrations and the scientific committee of the European Union Agency for Fundamental Rights.
In this Guest Speaker Lecture, Pr. Basilien-Gainche will address the situation of Afghan women under the second Taliban regime, which has been defined as a form of gender apartheid. Building on the recent judgment of the Court of Justice of the European Union (CJEU) delivered on 4 October 2024 in cases C-608/22 and C-609/22 (Bundesamt für Fremdenwesen und Asyl and Others), the lecture will examine whether and how this context may lead to recognition of refugee status under the 1951 Geneva Convention. Particular attention will be given to the CJEU’s interpretation of persecution and the notion of a particular social group. Based on these insights, we will explore their intersection with digital technologies applied in border management and control.
