LSTS Researcher Ashwinee Kumar will present the case KL v Vodafone GmbH (C‑594/25). The dispute concerns Vodafone’s transfer of “positive data” (contractual information that does not relate to payment defaults or misconduct) from mobile phone companies to credit agencies without explicit consent (§3). The Regional Court of Lübeck has asked the CJEU whether Article 6(1)(f) GDPR on “legitimate interests” can justify such mass transfers, especially when credit agencies use the data for profiling. It also raises whether the mere loss of control over personal data amounts to compensable non‑material damage under Article 82 GDPR.
