📝 ABSTRACT
"As AI systems become increasingly involved in clinical decision-making, a central question is becoming harder to answer: when an AI-supported clinical decision causes harm, who bears the liability burden?
Clinical Decision Support Systems (CDSSs) introduce an AI component into the clinical decision-making process, where decisions are otherwise shaped by the physician and the organisational context in which care is delivered. Depending on how the system is designed and used, AI may perform different tasks within this process, making it difficult to determine where a failure originated and how liability should be allocated between the physician, the AI provider, and the hospital. This uncertainty can in turn limit the development and uptake of these technologies.
The presentation examines how liability risks can be assessed in this setting. It first considers how different levels of AI involvement affect the allocation of tasks within clinical decision-making, through an adaptation of the Levels of Automation Taxonomy (LOAT) to clinical care. It then reconstructs possible failures across the human, technical, and institutional dimensions of the system, and considers how these failures interact with the applicable liability frameworks."
