On 4 April 2024, 12:30h - 13:30h CET, LSTS member Pablo Trigo Kramcsák will present his PhD research, entitled ‘Legitimate Interest as an Adequate Legal Ground for Processing AI Training Datasets’, followed by discussion.
Abstract: Developing and training trustworthy AI systems implies processing large amounts of data. Collecting, combining, and correlating accurate, representative, and well-organized/labeled datasets have a significant impact on detecting, mitigating, and eliminating bias and discrimination within AI.
Personal data constitute a crucial input for the precision and effectiveness of AI systems. This has led to tension between AI development and personal data protection law, especially concerning the lawfulness of data collection and processing for building AI training datasets. When collecting and using personal infomation, data controllers must identify a valid ground for processing: the data subject’s consent or another legal basis.
Given the difficulties involved in obtaining a meaningful data subject's consent in the AI development context and relying on this consent as the condition for processing personal data, the legitimate interest of the data controller (developer of a given AI system) or third parties emerges as an option. This lawful ground might be an appropriate basis for processing data necessary to design and enhance non-discriminatory AI systems.
