On 4 June 2024, 12:30h - 13:30h CET, LSTS visiting scholar Zuzanna Choińska (Ph.D. candidate in the Doctoral School of Social Sciences at the University of Warsaw) will present her work-in-progress, entitled ‘Finding a balance between privacy and public security in the era of big data – mass surveillance activities of Europol’, followed by discussion.
Abstract: Nowadays, the fight against crime is hampered by rapid technological developments, requiring the adaptation of new tools by law enforcement agencies – often provided by private actors. However, due to the amount of data processed by new technologies, the question arises of how to effectively fight crime while protecting citizens' privacy.
This research aims to analyse the question of the balance between these two values in the light of the jurisprudence of the CJEU and the ECtHR. This will be done by identifying the criteria for the protection of privacy in the case law and then, using the example of Europol, discussing how these principles are implemented and whether law enforcement authorities in the EU should be given more powers to protect citizens' security and their data more effectively. This will also be done by identifying the bases of the agency's data processing and analysing the big data-based tools it uses – Clearview AI and Palantir.
