
LSTS Professor Joris van Hoboken, LSTS Researcher René Mahieu and Hadi Asghari published a new paper, entitled ´Responsibility for Data Protection in a Networked World: On the Question of the Controller, “Effective and Complete Protection” and its Application to Data Access Rights in Europe´ in the latest issue of JIPITEC (Journal of Intellectual Property, Information Technology and Electronic Commerce Law), edited by Prof. Dr. Axel Metzger. This is also the anniversary issue for the 10 years of the journal. The paper, by analysing the current framework in Europe, attempts to determine who is responsible for observing data protection obligations in a networked ecosystem. The authors reflect upon two issues: (a) the ambiguity that characterises the data controller concept in a networked setting and (b) the insufficiencies for establishing the respective responsibilities in cases of joint controllership.
