Abstract
Current EU data regulation continues to place a strong emphasis on ensuring the maximum reusability of data, including public sector data. This objective, however, is constrained by the conflicting rights that may apply to such data. The presentation will first introduce the basic premises and overall concept of the planned habilitation thesis, before turning to the specific possibilities and obstacles surrounding the publication and reuse of public sector data that also qualifies as personal data.
The discussion will address the position of the data provider (the public authority), including the limitations introduced by the case law of the CJEU, in particular the decisions in C-92/09 and C-93/09 (Volker und Markus Schecke), C-439/19 (Latvijas Republikas Saeima), C-184/20 (Vyriausioji tarnybinės etikos komisija), and C-37/20 and C-601/20 (Luxembourg Business Registers). It will also consider the situation of any subsequent user of such data and the obligations imposed on them by the GDPR, particularly regarding the existence of a valid legal basis and compliance with the duty to provide information. The aim of the presentation is to further the discussion on balancing rights and public interests in the use of public sector data. Any feedback is most welcome.
